Privacy Policy
1. These personal data protection rules (hereinafter referred to as the “Rules”) set out the rules for the processing of personal data of buyers during the sale and purchase of goods and services and related activities (hereinafter referred to as the “Buyer”) offered by the commercial company 100MEGA Distribution s.r.o., Company ID No.: 60707968, with its registered office at: Železná 681/7, Horní Heršpice, 619 00 Brno, registered under file number C 15317 in the Commercial Register maintained by the Regional Court in Brno (hereinafter referred to as the “Seller”) on the website enbat.eu and set out the rights and obligations of the parties.
2. The Seller is the controller of the Buyers' personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, as amended (hereinafter referred to as the “GDPR”). The Seller processes personal data in accordance with legal regulations, in particular the GDPR: a) of Buyers who have registered with the Seller and concluded a purchase contract with the Seller. b) of visitors to the Seller's website.
3. When registering and concluding a purchase contract, personal data necessary for the successful completion of the order (including first name, last name, address/registered office, telephone number, email address, company ID number, VAT number) is required. The purpose of personal data processing is registration for the implementation of the contractual relationship, processing orders, exercising rights and obligations arising from the contractual relationship, handling complaints, debt collection, verifying and evaluating payment history through debtor registers, own marketing and business purposes, including direct marketing (sending commercial communications, sending gifts).
4. The legal basis (title) for the processing of personal data is the performance of a contract pursuant to Article 6(1)(b) of the GDPR, the fulfillment of the controller's legal obligation pursuant to Article 6(1)(c) of the GDPR, consent pursuant to Article 6(1)(a) of the GDPR, and the legitimate interest of the Seller pursuant to Article 6(1)(f) of the GDPR. The legitimate interest of the Seller is the processing of personal data for direct marketing purposes (sending commercial communications), sending gifts to Buyers based on the rules relating to the contractual relationship, verifying and evaluating payment history through debtor registers. The Buyer may object to the processing of personal data for direct marketing purposes in the scope of name, surname, email address, telephone number, the Buyer may object in accordance with Article 21 of the GDPR at the email address enbat@100mega.cz. In such a case, the Seller shall not further process this data until it demonstrates compelling legitimate grounds for the processing which override the interests or rights and freedoms of the data subject, or for the establishment, exercise or defense of legal claims.
5. The Seller uses the services of subcontractors to fulfill its legitimate interests, in particular mailing service providers (personal data is stored in the EU) and hosting service providers. Subcontractors are vetted for the secure processing of personal data. The Seller and subcontractors have entered into a personal data processing agreement under which subcontractors are responsible for the proper security of the physical, hardware, and software perimeter and are therefore directly liable to the Buyer for any leakage or breach of personal data.
6. The Seller stores the Buyer's personal data for the period necessary to exercise the rights and obligations arising from the contractual relationship and to enforce claims arising from these contractual relationships (for a period of 15 years from the termination of the contractual relationship). After this period, the data will be deleted. The Seller stores the personal data of website visitors until their consent is revoked.
7. The Buyer has the right to request from the Seller access to their personal data in accordance with Article 15 of the GDPR, correction of personal data in accordance with Article 16 of the GDPR, or restriction of processing in accordance with Article 18 of the GDPR. The Buyer has the right to erase personal data in accordance with Article 17(1)(a) and (c) to (f) of the GDPR. Furthermore, the Buyer has the right to object to processing in accordance with Article 21 of the GDPR and the right to data portability in accordance with Article 20 of the GDPR by sending an email to enbat@100mega.cz.
8. The Buyer has the right to lodge a complaint with the data protection authority if they believe that their right to personal data protection has been violated.
9. The Buyer is not obliged to provide personal data to the Seller. However, the provision of personal data is a necessary requirement for the conclusion and performance of the contract, and without the provision of personal data necessary for the fulfillment of the order, it is not possible to conclude the contract or for the Seller to perform it.
10. Personal data will be processed automatically.
The Seller does not make automatic individual decisions within the meaning of Article 22 of the GDPR.
11. By filling out the contact form, visitors to the Seller's website:
• a) consent to the use of their personal data for the purpose of sending commercial communications from the Seller and, at the same time,
• b) declares that they do not consider the sending of information pursuant to point a) to be unsolicited advertising within the meaning of Act No. 40/1995 Coll., as amended, as the user expressly consents to the sending of information pursuant to point a) in conjunction with Section 7 of Act No. 480/2004 Coll.
• c) the consent under this paragraph may be revoked by the user at any time in writing by email to enbat@100mega.cz
12. The provider uses cookies in its presentation to improve the quality of its services, personalize its offer, collect anonymous data, and for analytical purposes.

13. The buyer was familiarized with these rules before concluding the contract. By signing the purchase contract, the buyer confirms that they have read these rules and accept them in their entirety.
14. The Seller is entitled to change these terms and conditions. The Seller is obliged to publish the new version of the rules on its website without undue delay or send the new version to the Buyer at their email address. If the change requires the consent of the data subject, the new version will be submitted for their consent. If consent is not given, the personal data provided for consent will no longer be processed and will be deleted.

16. Relationships not expressly governed by these terms and conditions shall be governed by the GDPR and the legal order of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, as amended.
These rules shall enter into force on February 9, 2024, and form an integral part of the Terms and Conditions.
